So, you've procrastinated long enough, but it's time to speak about it - Estate Planning. It’s the topic that nobody wishes to speak about, however, you have to deal with it at some point in time.

What does Estate Planning mean? Essentially, what happens to your belongings after you pass away? It's not a great topic - everybody likes to think they're Immortal - maybe we are?

However, it makes life a lot easier for those survivors in your family if you document your wishes while you are still a living and competent individual.

What do we do when we set up a whole estate planning package in order to effectuate your wishes and clearly convey them to the executor of your estate? One of the things of course is draft you a Will. If you have minor children it is a Will with an Appointment of Guardianship of minor children. The Will dictates what heirs get certain items what happens with certain assets. As we have seen, perhaps more importantly the Will also specifies who the guardian is of your minor children. If you do not have a surviving spouse or biological parent of the children as a survivor – the Estate Planning package we assemble that includes a Will with Guardianship appointment. Regarding Real Estate the Estate Plan also includes a trust for any properties that we wish to convey outside of the probate world. 

We include a health care directive or Living will which says what happens if you are ill and in an incapacitated state (may not be operative or binding in All States but still conveys your wishes to the Proxy) it includes a health care proxy elective which is the person who makes those decisions and includes the power of attorney if that person has to handle some business Affairs while you are incapacitated or even have a short-term surgery.  This whole package is something that can be done quickly and expeditiously via competent estate planning attorney it goes hand in hand with all real estate transactions as well and it's something that nobody ever likes to think about, however, if you assemble it now and then put it in place for a long duration you're surviving spouse and or heirs will thank you in the future.
